California Health Code Violation - Dogs on Patio?

Hey Gang,

Since we have experts on everything in this place..

Is anyone familiar with an ordinance, rule, law, etc. that doesn't allow dogs on the patio of restaurants?

Of course I know that dogs can't be brought into restaurants but I was always under the assumption that on the patio was okay.

I was recently told that there is a health code violation for having dogs on a patio and a restaurant can be severely fined.

Does anyone have any specific information on the matter?

B-Line you are correct. From what I read it's anywhere food is served, while that makes zero sense since I'd argue it should be where food is "created and prepared" it's CA for you!

I know it's a not highly enforced, I take Biscuit most places on the patio but I have been told from time to time.

Thanks QS,

But doesn't that refer to indoors ????

Cause it says, "in a room" and "in a facility"

Since the dogs are outside, on a patio, isn't that a different interpretation of the law?

And no it's not legal; Read it again...... carefully.
I believe if a restaurant decides you can't do it,
then you can't do it.

Seems like your looking for an reason to justify bringing
fido along for your patio experience. May i offer a thought?

It seems that dog owners should know that the presence
of animals in and about eating establishments can make people
uncomfortable. That being the case why not error on the side
of caution and allow the law of human kindness to save the day.
Give Fido time out away from the Patio experience.

Secondly we also know that animals can also be unpredictable.
No need to get into a bad situation because we didn't think Fido
wouldn't go that far..

Hi Barry,

I do appreciate. Thank you. But to be honest, every time I have ever brought Maggie or Nikita to a restaurant, which is often, I get stopped over and over and over again with people who approach my dogs and share the love.
- I have never once received a complaint.

Just to be further clear, if I were sitting down at a restaurant and a couple sitting near me expressed their displeasure with being seated next to a dog, I would move or go to a different restaurant, NO PROBLEM..

I don't impose my dogs on anyone who wishes to not be around them.

So what we are really talking about is public courtesy, be it loud cell phone talkers, screaming kids at movie theaters, smokers, etc.

Some people feel they have the right to do what ever they want to do when ever they want to do it. I'm not one of those people. I constantly try my best to be courteous of other people.

And if someone said, "please don't sit that dog near me" or something to that effect, I would understand and move along.

But I promise you, most restaurants in LA would rather have my business, with my dog at my side, than have me eat at home.
