Sotomayor, Supreme Court...issues.....
This should be interesting...
U.S. Supreme Court overturns ruling backed by high court nominee Sotomayor in white firefighters' discrimination case. Quote:

Who was the swing vote? 5-4 is close.
Here is the full text of the decision w/ dissents. http://big.assets.huffingtonpost.com/07-1428.pdf |
I would hope the split is always close, if it isn't there is a HUGE problem when reviewing another courts ruling IMO.
In the original: In June 2008, Sotomayor was part of a 7-6 majority that denied a rehearing of the case by the full court. Lets get this straight, they scored higher on the test but didn't deserve promotion?? :dunno: Quote:

Its about time, discrimination should work in both directions.
We had the same problem here with police were they said the tests are too hard for African Americans. So the city actual paid African Americans to avoid any major law suits. This is crazy either you got what it takes or you don't. This is a discrimination towards educated people, period! |
I can not believe Ginsburg's statement - just what was the purpose of taking the test?

I vote to remove the race checkbox from applications, examinations, etc. Let it be 100% purely by qualifications. But logic like that is far from reality.

But if there was absolutely no way to know the race by the application or evaluation etc. then there is absolutely no way to play the race card. Let it be solely based on performance and qualifications, nothing else. Then the people with little to no qualifications/skills will be forced to man up. Sink or swim. (I still believe in survival of the fittest in some circumstances) But unfortunately if the unskilled people can't get jobs due to lack of skill, not being the better man for the job... then the Government would inevitably put them in government housing, on welfare, and with stimulus check in pocket... |

People aren't hired without a face-to-face interview, at least in any industry I can think of, regardless if "race" is on the application or not. Therefore, race (or gender, or age, etc.) will never be out of the hiring equation completely. Promotions based on examinations or physical skills may be free of possible discrimination, but you got to get the job first.
