Lift gate opens inadvertently

OK, I have an interesting one. Took my '04 X3 to the dealer a couple of weeks ago for a handful of little things--a recall notice, install new tires, etc. On dropping it off I had one last request: For some reason, I seem to inadvertently open the lift gate. A lot. Not when the key is in the ignition, but when I put it in my pocket, take it out, change hands, etc. I had chalked it up to the fact that I was wearing gloves here in the colder months and was just fat-fingering the buttons on the key. So I asked the dealer if they could possibly code the key so it took a double click to open the lift gate. Well, the dealer agreed that there was something wrong--evidently the lift gate is programmed on a delay, and you're supposed to hold the lift gate button for several seconds before it opens. But they haven't been able to figure it out. Two weeks later, I'm still driving the dealer's loaner. Not complaining--the loaner is a sweet '09 535i with x-drive, 2000 miles and every option BMW makes. Evidently, the dealer has been talking with the engineers in Germany virtually every day. Reprogramming the computer, new computer unit, etc. Two weeks later, they haven't given up, even though I've given them a couple of chances. But I thought I'd share my experience with the group and see if anybody has had similar. If so, how did your dealer end up resolving it? Thanks.

Postscript to the story

Got the vehicle back from the dealer yesterday. After 2 1/2 weeks of consulting with the engineers in Germany, they decided this was "normal operation". According to them, I have an early production model and this is how they were programmed. So, I guess I live with it.

Mine opens with a relatively short push, perhaps 1-2 seconds and it will pop open. However, I've been delicate enough to not inadvertently do it too much.

You can program the key so that the rear hatch only opens if the doors are unlocked. This is a Key & Vehicle memory function that the dealer can set.

Bumping an old thread, but my rear hatch is opening while driving down the road. Or sometimes it won't open when the doors are unlocked. Do i have to get the dealer to reset the Key and Vehicle memory reset?
