I didn't ask if the DISA valve was old or new. The flap on the DISA valve could be sticking and the whole ideal behind the DISA valve is change the length of the intake runner and thus the oomph of the engine.

Just because it is brand new doesn't mean that it is not the problem.

Another item to check might be the ICV. Check to see if it rattle when you shake it.

Makes sense. Sticking, like inside the intake due to crud build up? Or sticking from an actual manufacture defect. How would I even diagnose that?

You can remove the DISA valve and move the flap slowly. Don't rotate the flap and let it snap back. Do you feel any resistance throughout the flap as you rotate it?

Hmmm try the G.A.S. procedure first

Let me guess you bought the Vaico valve from ECS and not the Genuine one correct? I would probably send it back and get my money back if its bad and buy the rebuild kit with new and improved flap, parts, and O-ring seal from

G.A.S. Home Page - I rebuilt my OE DISA valve and its been working great for years.

I would say put the rebuild kit on the Vaico valve if that is what you bought but I dont know the quality compared to OE - also if you go on G.A.S. website you can try another troubleshooting procedure - hold DISA flap closed and finger over vaccuum pot hole, then release flap - it should only flap back open like halfway

I bought the ECS kit (w/screws) which the 12 year old who answered my phone call over there said was OEM for this part on the X.

Yeah, IDK about that.

Just bought the Genuine BMW one from them, will ship Thursday. Then mail this piece of shit back for a refund. Guess I'll put it all back together (in my work parking lot LOL I love my job) and motor on for a few days.

Yeah I'm looking at the kit contents that is the Vaico valve - aftermarket

Good job upallnight finding the problem - you're not much of a rebuild guy are you? The G.A.S. kit is very proven, tmv and I among others have had great success and the parts really are stout, if you still had your OE valve I would have either slapped the rebuild kit on or buy the new OE valve with DISA kit installed from G.A.S. - they call it the "Gold Valve"
