You've got a short somewhere but I haven't run into that so no idea beyond that sorry.

Check the trunk lid opener button in your dash(one of those four in the middle behind the gear stick).Might be stuck.
If not try spraying contact cleaner in the light switch and in the trunk lid opener button.
I use isopropilic alcohol spray.
You can get it in any electronics parts shop,or some hardware stores must sell it.
If none of these will fix the problem, then you have a short in the wiring harness somewhere, which will not be easy to spot...
Hope this helps

When the e38 sedans & e39/e46 sedans & Tourings have weird issues with the tailgate and other seemingly unrelated components...it pays to look closely at the wiring looms that have bundled wires going from the tailgate into the body. As the tailgate or trunk lid opens/closes...it can eventually break/chafe the wires causing shorts.

If nothing else...it would be a place to investigate since it is a place where the lights (rear tail lights) and the tailgate electronics come in contact with each other. Those electrical loom (up near the hinges) carry wiring for all rear lights and tailgate functions through those corrugated looms you can see when you open the tailgate

Examples of what has been found after examining the loom of various BMW trunks & tailgates:

^Yep, used to see those come into the shop like that and require patching. Definitely worth taking a look at as it doesn't take but a few minutes.

Location of the looms were mentioned...and would naturally be located where the tailgate and body of he car remain the closest as the tailgate is opened/closed (look up near the hinges where the tailgate is attached to the body of the car). :)

Also see #3 in the "added" diagram below which also indicates the location of the major wiring harness that goes from the body of the vehicle to the tailgate:
