oil capacity??

I have a 05 4.4 and I did an oil change couple weeks ago with Mobil 0w40. I drained the oil out, changed the filter and put half a quart of oil into the new filter before installing it back. I bought total of 9 quarts of oil and after putting 8.5 quart like the manual says, I drive the car till normal temperature and parked for 5 mintues then checked the level. The oil level was at the MIN mark so I added the rest the half quart of oil and checked it after a long drive and watied 5 min like the manual says before checking the level. I checked it and it was at the middle mark between MAX and MIN. My question is that when the manual says capacity 8.5 quarts of oil, shouldn't the oil on the dipstick should be very near the MAX.. I put 9 quarts of oil and still its only in the middle. Any idea why this is like this?

No idea. I just put 9 quarts in after changing out the filter and go. :) I found that putting in only 8.5 quarts, leaves me at the bottom mark, so I filled to 9 and good every time. :)

on the subject of oil, I just got a check engine oil message, does BMW give you the oil based on the included maintenace, or are you supposed to do that yourself?
