Technical Service Bulletins... Customer Pays?

I want to thank the posters who pointed out the TSB for the sticky throttle pedal issue... but when I called my local dealer- (BMW of Murray, Utah) the Service Foreman said my X5 was not under warranty and I would have to pay for it.

I do not want to be unreasonable, but if enough cars have a problem to issue a TSB should'nt it be a factory expense?

Anyone know where I can buy part number 35 40 6 762 480
Accelerator pedal for: E53 vehicles with automatic transmissions at a reasonable price?

I think you are confusing a TSB with a recall. A TSB is just a recommended repair for something that they are aware could be a problem. If it were a major safety issue, then they would have to issue a recall which would be on their bill.

Only recalls are performed without charge.

Thanks for the diagram. I hear you about the difference between recall and TSB. I also know that sometimes the dealer will do things like a TSB just becaue you are a loyal customer, such as the time my entire dashboard was replaced after it cracked--- maybe it was because I used to be so active in the BMWCCA.
It did not hurt to ask my dealer and I was not upset when he told me the situation. He was nice about it- I was too.

Now, does anyone know whats inside the box that causes the friction? Can I fix it, or do I need the part? ($98 at the dealer- in stock).
