They are obviously trying to avoid a law suit, and the negative publicity that goes with it, and the recall/inspection that something like this may bring upon them.

Yes, you may be able to sue them if you go to a lawyer, but in this sue-happy days...I personally am not in favor of this. Don't get me wrong... I believe law suits do serve a purpose... they make sure that manufacturers don't cut corners and this and that... but in a case like this, I would personally just take the cash offer (for the hell of it) and sign the release form.

They may be trying to avoid a law suit, but don't count on it. They are equally likely to be offering to invest in future business, essentially retaining a loyal customer.

A settlement offer isn't an admission of guilt, as it is nearly always offered 'without prejudice'.

Because they offered to settle subject to a non-disclosure agreement. It is usually the condition right after the 'without prejudice' clause.

But if he didn't take the money, then there is no agreement.

But the offer was likely subject to an NDA. If he goes public, then he loses his opportunity to take the money, unless he lies on the settlement contract.

Honestly it still smells to me.
