Having Problems at the Stealer, Please Help.....
 
First off, I have a 2006 4.4i with 47k on the clock.

I took it into the dealer with some transmission complaints. The X had the notorious clunck on hill starts and from rolling acceleration. Also sometimes i felt like it could find the right gear on he hwy.

The advisor called me the same day saying that his tech also noticed that something wasn't right. He had said that they submitted a claim into BMW NA and are waiting for a response.

The next day i call to see how its going and the advisor told me that BMW NA had said to release the vehicle back to the customer. I was pretty shocked and told him that I did not want to have a bigger problem in the future seeing as how my warranty is out in less then 3k. He told me that his service manager will give me a call to explain the situation.

Right now I am still in a loaner car and waiting for a call tomorrow morning.

Please help any way you can. How should I approach this situation?

I really don't want to have the tranny go out right after the warranty ends.

The dealership is BMW of Bellevue in the Pacific Northwest.

I wouldn't take the car back. If you and the dealership noticed an issue then it must be taken care of. Looks like they're waiting for your warranty to expire.

If they can't or won't fix it, keep all your documentation such as the service report and work order, just in case it does fail. If the problem was noted prior to the expiry of your warranty, you have grounds for an appeal at that point.

Get what they said about that they know somting is wrong in the tranny written on a paper, whit date, name of tech and adviser and that its 3k til end of warrenty.
This document vil be needed in the future.

I'd wait to see what the service manager has to say before calling BMW NA. When you get the vehicle back make sure the work order comments match what was discussed with the SA, Tech and Manager.

As the previous replies indicated, problems noted before warranty runs out usually covers you if it gets reassessed later.

Got a phone call today from the service manager. Now they are claiming that there was a misunderstanding and they could not replicate any problems with the transmission. They are asking me to come in and go for a drive to replicate the problem.

Can I get some advise please on the most effective way to do this?

ask them to check the mechatronics module (I think that's what it's called). I think the number is 24-34-7-543-479. I was having hard shifting at low speeds and that is what they found was at fault. They also installed ISTA/P verison 34.0.0.5 programming. I hope that helps.
