Car was not SOLD as a CPO car, but as an AS - IS car. That should have raised some flags, especially since they weren't going to sell you a third party warranty.

Even then - considering what he found on the car, is there absolutely no re-course for him with the Dealer? This is tantamount to a con job on their part.

As stated: there is a warranty on the car they will not honor.

BMW NA actually had to buy my previous car back from me - sold to me as a CPO but was frame damaged and totaled, bought at auction and washed. The X5 was the replace. BMW NA told me to contact them if I had any issues at all and they would make it right. Apparently not.

Do they say why they won't honor their own warranty? Do you have your notes from your last encounter with BMW NA? Maybe track back on that and get to the person you dealt with before. You have shown loyalty by sticking with BMW and now this.... :(

It is never fun to go all Legal on these kinds of situations, but from what I am seeing - it seems you are being lumped with a bad car.

Are you still in California?

Sure they like to sell new cars.

On the other hand, used cars need more parts and parts are very a very profitable sale for the dealer.

Regardless, the brand is far too important that BMW anywhere would ever approve of someone telling a customer they are not BMW clientele. I am interested in the rest of the story.

The person who handled the buyback moved on from NA. It did take 7 phone calls including one where the point of contact person put me on hold and got up to go to the senior rep's desk and ask her why she wasn't returning calls and wouldn't talk to me. The guy seemed really frustrated with her when he got back. I will say that even if it had been a new car, I don't think it would have gone any differently with this particular person. They just could not be bothered. One of those reps that refuses to give you a last name or email even though everyone else has. Rep's name was 'Jessica' in case anyone is so unlucky as to deal with her. I did eventually ask her if she thought her attitude constituted 'ultimate service' given what I had in writing from NA regarding another purchase of any sort or what had happened previously - but I did also state that I knew there was nothing they were obligated to do. And tried to be reasonable about bent valve covers, washed titles on a previous car, a dead rat I found in this one down by the fuel lines (forgot to mention that in my initial write up). Did not seem to care the car was sold this way, was a fire hazard, that I had had 2 BMWs which were dangerous - the frame damaged car having pullouts on the crumple zones, etc., etc... She basically didn't do anything except send an email to the sales staff at the dealership - not much (And considering she wouldn't give me her email for any kind of updating...). Not required as I said, but not impressed either.

I say dump it and get something else. In addition to your current issues with the vehicle and personal life, it will nickle and dime you. I have been toying with the decision of getting rid of mine and get something brand spanking new as im not in the state of mind to be fixing things

Unless the car is still under warranty, most X owners will take it to an Indy or perform the work themselves and most owners/Indy will use aftermarket parts.

I acknowledge I am basing my opinion on personal business experience with little documentation.

Dallas/Ft. Worth metroplex has pop. of around 6 million. I know it is a significant BMW market. There are 8 'BMW' Indy shops that come up on Google. I know a little about each. All 8 do work on other imports. 7 of 8 are not impressive at all, quite small and not pretty. 2 are focused on BMWs but primarily mods. It doesn't appear the BMW Indy business is booming here.

I think that unless a customer requests aftermarket parts the Indy shop would purchase parts that generate the most profit dollars. It seems logical that one of the reasons BMW parts are so expensive is that BMW builds in an attractive wholesale discount that still leaves a nice profit for BMW and the dealer. I know that in general that is very widely used model in any parts business.

There are 3 HUGE BMW dealers in DFW. Service is by appointment that is always 3 to 7 days out. My service advisor guesses 25-30% of the service business is out of warranty owners that are exclusive to the dealer and another 5-7% have some of their work done by the dealer.

It would be interesting to know the total number of members of all BMW forums. I think we are a major representation of a very exclusive, unique and shrinking minority of those that DIY.

Assuming the dead rat should have found them it they didn't find it--how much of the other problems you have found were visible or generating symptoms?
