Defective Airbag Settlement confusion
 
I just got mail from the Auto Airbag Settlement and have some confusion after looking at the website.

So, when I go to file a claim, it asks me a few questions- one of which is about whether I went to do the recall. As BMW is delayed on recalls not our fault, I answer no- and am not eligible?

It's hard to figure though this legalese what exactly is covered. Is it just the costs people go through to get the recall done? Scummy lawyers like to be ambiguous.

Perhaps it is best to opt out from this, in case while waiting for the recall- if I get injured by the airbag(s), I can still file a suit for any injuries?

Reading the FAQ, sounds like it will reimburse you for out of pocket costs associated with replacing the air bag.

What are you trying to claim? Have you suffered losses as a result of the faulty airbags?

Nothing but wanted to know because they are delaying the replacement, so in case something happens...

any vehicles has current recall(s) outstanding, it de-value the vehicle.
not sure what each state law has with recall vehicles, but in California, dealership must address and fix all recalls before putting it back for sell, exclude used car dealerships.

I had my driver's side airbag replaced...with another know defective airbag. Since they had no available good airbags, the put in a somewhat newer bad airbag, which in theory reduces the chance of a failure. Still have not heard from them about getting a proper airbag replacement done.

I had my drivers side done 2 weeks ago and now have a appointment to do my passenger side. The dealer was acting a little funny about not having them until I showed him the letter from BMWNA! Then he perked right up and made me an appointment for the next day! They kept it 2 days. Apparently it is not an easy job.

Ugh. Mine still says that only 1 of the 2 are available. I really don't want to have to schedule 2 appointments.

I didn't either. But, I found out later that one of the "SA's" sold my passenger one to someone else!! So, no choice.
