First thing I would do is clearly (and non-emotionally) document everything that has happened in chronological order and Herb Chambers response and set up an appointment with the heads of and service and say that you want them to buy back the car based on your reliability concerns - its worth a shot. Don't waste any more time talking to the SA's - insist on talking with senior staff from now on. Document every discussion from now on. At the same time I would contact BMNA and push up the ladder as far as you can - you may get the 'independantly owned' BS but you need to push and approach from every angle. I seem to remember other members being successful here with other dealer buy-backs (not E70's) so maybe they can help with whether or not you have a real case and if yes, give some advice on the best way to pursue it. Although it has been a massive headache I doubt it would classify as a lemon. I've had bad experiences in the past as well with nearly 10 BMW's to date. My suggestion is to go to another dealer and tell them about the ordeal and be firm about what needs to be done. Drop your current dealer and tell corporate about them and name names.

Sounds like you know the Lemon law better than I do, so I stand corrected. If that is the case then perhaps it might be the best solution since this entire thing is costing you a ton of time as I can only imagine. Perhaps you can speak to corporate and the dealer about trading it in for something else?
As much as I like the new X5 I try to avoid early production runs of brand new cars for all the headache they can cause. Nowadays the problems seem to be electrically related and linked since the car is basically a computer on 4 wheels. I'm truly amazed that you've had suspension pieces replaced! One would expect at least that such components are robust enough for day to day driving, much less the occasional offroad stuff an SUV/SAV is built for. Shame on you BMW. |
