Something doesn't sound right here, either theres more to the story or you definitely need to find a new dealer.

Your driving close to 12K miles a year which is pretty close to the National Avg.(which I think is around 15K)

I've had the battery drain issue twice but my X5 has less than 5k miles per year. I don't think you should have it, given the miles you are putting on.
