Quite possible, but I wouldn't think that a 1 mpg decline would drop the credit 50%, and I can't imagine they'd drop it by 2 mpg.
It would explain the delay however, if they were arguing/negotiating with the EPA.
Still, I think a web mistake is the most likely explanation, especially since the Website X5 2010 specifications still show the same 26 mpg hwy for the X5 diesel.
