The BMW mats have a very strong and large surface velcro on the bottom. You simply cannot slide it with your feet no matter how hard you try.

My LS 460 wasn't included in the recall. I don't think any of the cars made in Japan were included...

If you do not have a carbon copy of the "We Owe You" form you have no recourse.

I'm thinking about buying another. A GX 460 to replace my X5...

A written contract would not be required for the floor mats detrimental reliance, exists as does as a quasi contact, both of which require no written contracts.

Unjust enrichment also comes into play, but this is an academic argument and we're talking about $120.00 floor mats.

Those things would be arguments for small claims or superior court. But, am I going to waste a day for mats?

Probably not. Though, I do fully expect BMWNA to rectify the situation with a check or delivery of the mats.

In the meantime, I'll buy a pair, as I don't want my 35d to be damaged.

Same story we've all heard 1,000 times, which is why "Car Salesman" have such atrocious reputations for their unethical behavior. It's really quite an unusual profession, in terms of the level of distrust that exists in the field. Oh well...

Or, the manufacturers could sell every car "with mats"; maybe nice carpeted ones,
or all weather for the northern climes, or cheapazz budget mats for those buyers
that don't care. My comment is that it is remarkable that in $50G+ car, or even
in a $25G car, the mfg'r does not build in another ~$35 FIC for mats, as "standard".

The car guys want everyone to spend $3Gs per "package", of stuff some of us
don't want, and then ala carte basic such as "mats".

I got the nice carpeted mats, way back on our '01; they are showing some heel
wear on the driver's side, but still look good. How BMW can not put them in at
the assembly stage or leave it up to the dlr, is remarkable to me, from reading
current posts by people here, whom have recently taken delivery on a fairly
expensive purchase.

Lexus comes with mats. All of my BMW's have not come with mats. The dealers throw them in, but they aren't included with the price of the car from BMW.

Maybe I wasn't clear on my post... When I picked up my X5 for PCD they did include mats which I did not pay "extra" for. I was told in an email that it wouldn't have them but they were installed at pickup so saying they aren't included in the price is incorrect as others have said they also received them.

They are a basic black carpeted floor mats nothing to write home about and as I stated replaced them with a more durable liner to protect a bit better.

I wonder if some dealers remove them at delivery..

I would not buy a Lexus, why, because they are simply re-branded Toyotas. And I do not trust Toyota. It'll be interesting to see if the Lexus brand avoids contamination from this un-intended acceleration fiasco. In the meantime, more light is being shed on this issue:
