That is a crazy lawsuit. Something tells me the only people that will benefit are the lawyers.

BMW had fuel pump issues across many cars in 2008. My X5 had three of them and my SA talked about all kinds of issues. But -- they did fix them and appear to have caught up with the problem.

I agree with other posters, BMW is making it difficult to want to own a car out of warranty.

Is it the wastegate armature they are hearing, or the solenoid that controls it?

Probably right once again, but it seems that the N/A six would be cheaper to maintain and more reliable for long term ownership. I mean, BMW has the N/A straight six thing down to a science by now, but turbos, overheating issues, hpfp failures, etc. How can it be as reliable as the N/A version?

I think that the NA version may be slightly more reliable, partly because of the lower stress and partly because of fewer components, but I think it is not as big an impact as the difference between the direct injected version and not.

I also think an E46 would be more reliable and cheaper to get to high mileage than the E90, since the platform is simpler. Some of the electronics that cost $$$ have nothing to do with the engine.

I didn't have the problem on mine, but it appeared to be the door/flap that didn't close properly, and rattled on over-run after revving. They replaced both actuators and complete turbos at different times, whether that was due to two different problems, or a shortage of parts, I don't know.

Around the same time they were updating software, and I think it was the software change that some owners objected to, as they perceived different throttle response afterwards.

For a while when the wastegate rattle was first happening at my dealer we were just adjusting out that little bit of slack thus making it quiet without doing anything else. But when BMW released the software fix they stopped paying the adjustment claims as it wasn't the official fix...
