I'm having the same issue with my 2005 4.8iS. When I suggested a transmission service (including transmission filter) to my Indy, he recommended I take the truck to the dealer, as he didn't want to be liable for the transmission failing after the service, implying that it's happened in the past.

Mind you, I am not ascribing to his theory, especially that I had an e38 in the past and one of the 1st things I did after buying it, was to perform a complete transmission service on it, without any ill effects.

I've heard the "don't disturb the transmission oil" theory a couple of times before, and it always gives me pause when I'm contemplating an oil change or a service.

Thoughts?
