I think it's designed that way: against the windshield, it's not tight and creates a channel that ducts water up the window over the roof instead of around and onto the side windows. This way, when it's a light rain for example you could have your window down and not get rain from the windshield into the car..

Both my car's exhibit this situation, I thought it was just old rubber that got weak until I had my windshield replaced and post replacement was the same. Anybody here that took delivery of a new E53 that can confirm?
