Since time is running out I would pay the local dealer to CPO it and file a small claims suit against the previous owner. As far as I see it, the person that sold you the BMW made the 'error' (intentional or not) when he told you the car was CPO'ed and gave you the paperwork stating so. Did he state anywhere in the AD it was CPO'ed? If so I'd save a copy for your court date.
He can fight the battle with the local dealership and/or BMW NA if it was a mistake on their part.

All I know 100% is that I have a CPO'd cert that was "accidently" given out and it is not honored by BMW.
