I would imagine the only one who could file a legal matter with BMW would be the seller as the car was not purchased from BMW and authenticity of the CPO was awarded by the seller.

Unless the seller falsified something with the CPO paperwork. But I would at least follow-up with BMW NA and the dealer to find out who issued the paperwork. Regardless of who they issued it to, if they issued it, it should be honored, regardless of who owns it now, since it's transferrable.

The dealer says it started the CPO process but did not finish it.. They say that the certificate I have must have accidently been left in the car when it went to auction. They guy I bought it from said it was CPO'd. He did not tell me he got it at auction.
All I know 100% is that I have a CPO'd cert that was "accidently" given out and it is not honored by BMW.

You need to get that seller to ride this one out with BMW IMO. IMO, you really don't have much say in it as the CPO was done by the seller with BMW, if the seller didn't finish the deal they need to give you some funds as that isn't what you bought. However, if they did finish the CPO, they need to hammer BMW.

Contact the dealer where the paperwork originated for the cpo issue. Their position that the paperwork was "never completed" is hearsay. As far as the previous owner and you are concerned it was valid throughout his and your ownership periods. Unless the dealer can prove the paperwork you hold is a forgery, they are represented by it and should be obligated to honor it. Act like you are getting alawyer and negotiate, negotiate, negotiate, you get what you negotiate for in life not what you expect or think you deserve. At the very least the dealer should be glad to give you a big discount on an extended warranty unless he is hiding something about the vehicles history. Stand up to them, walk a picket line in front of their dealership for a day if you have to, I guarantee one lost sale is worth way more than them making you a happy BMW owner.

Thanks Teton.. I think you are the only one that has said if I have the certificate even if was by "accident" they should own up to it.
I'm calling the manager at the shop. Can't picket though.. I am in Denver they are in Las Vegas.. Guess a raod trip would not be bad!!

Since time is running out I would pay the local dealer to CPO it and file a small claims suit against the previous owner. As far as I see it, the person that sold you the BMW made the 'error' (intentional or not) when he told you the car was CPO'ed and gave you the paperwork stating so. Did he state anywhere in the AD it was CPO'ed? If so I'd save a copy for your court date.
He can fight the battle with the local dealership and/or BMW NA if it was a mistake on their part. -Jeff Quote:
