FWIW during the wait for my 2009 35d (build date 8/4/09) my CA emailed me screen dumps from this system every time I asked for them. I didn't want to wear out my welcome, so I didn't do this too often. But I did it at critical stages to confirm the info I was getting from the 1-800 #. His info was usually less than 24 hours better than the 1-800 #.
From what I'm reading BMW simply does not want to disclose the issue(s) that are delaying delivery of the 2010 X5. Not just the 35d.

I was told by two separate BMW dealers that 2010 X5 diesels for US market were in short supply due to international demand. I also know that the X5 is due for the 2011 update early, in about six months from now. Perhaps that has something to do with the problem? However, my X6, which I ordered only three weeks ago is currently being built. Since both X6 and X5 are built on the same production line, it is unlikely that there is an overall production problem. However, I also know that BMW had laid off some contract workers due to the global economy, and are now beginning to hire some of them back. Maybe there is more demand than they can currently handle.
