My Seat started on Fire
I'm in the Cold of Toronto Canada and I'm driving my beautifull 04 x3 down the highway and I turn on my seat warmer. Well as I'm driving I feel an extreem pain on my left a** cheek. So I take my hand and touch my own a** and then burn my hand. So I lift my butt off the seat and to my surprise their is smoke coming from my nice leather seats!!! I then stop the truck and get out in the middle of the highway and see that my seat is still smoking and my heating element has burnt a hole right through my leather seat. As well it had burnt a hole right through my jeans and burnt my a** leaving me with a nice red welt on it. Has anyone had this problem. I called the dealership and told them about it and they told me the seat element was not under warranty. When I told them that I would go to the media with this they told me to hold and then the nice service manager came back on the line and told me they would fix it out of good will. I'm thinking civil suit if you ask me. Wonder if I would be able to file a civil suit against BMW for this. I mean it actually caused personal injury..... Immagine if my child was seated in the passenger seat and this happened. |

I would have been outraged at the dealer if they told me the seat was not under warranty and to tough it out. That kind of fault is not about a warranty, but rather safety. They serve every right to resolve this problem at hand.

especially post from Tominizer, a fellow Toronto poster near bottom of first page. Search Tab, on this site, is also your friend...there is very little that has not already come up on the Juke Box and has been answered previously. Good luck on the fix; the idiot stlr should cover it, but they are inclined to toss you, out of Standard Procedure, as you may be out of warranty. So, let me get this straight ... You feel you deserve to be compensated because you have a slight burn mark on your bum? Please tell me you are only joking about filing a lawsuit ...
/Sarcasm on Yes, I believe you should try to be wealthy as a result of a burn on your tush. Actually, you should try to become a millionaire because of the red mark! Look at the humiliation and embarrassment you will have to endure for the rest of your natural life because of this red mark. People far and wide will stop their cars in the middle of the street to gawk ![]() Get real. The heating element burned out. It didn't burn your child so never mind imagining it did. Wait a second, it burned your parents child, so YES, YOU SHOULD FILE A LAWSUIT. Whatever you do, don't waste any time. In a week, everything will be back to normal on your once flawless pooper, but you should profit as much as possible. If your interior light burns out, you should file a 2nd lawsuit. What if your child was trying to do her homework on the ride home and can't finish. As a result of the gross negligence of BMW, she will fail the class, then fail the grade, be a pariah in her own school, drop out, have low self-esteem, take drugs, OD, and eventually die all because of a faulty bulb. BMW MUST PAY, AND THEY MUST PAY NOW !!! /Sarcasm off Or, you can accept the fact that your out of warranty Bimmer had something fail it, and have it replaced at 1 of 30 places in the largest city in Canada. Just my $.02 ...

I have been reading up on a lot of people have problems with the seat getting to hot. I think sue might be going a little to far, but I do think the dealership should have tried hard at first to help you out. If anything look at trying on getting a recall on the seat.

I am just wondering if, at any point during the alleged butt-burning, it occured to the original poster to turn the seat heater off. Maybe that would be too logical. Better to just sit on the seat until welts form.
To the OP: It is a failure several years out of warranty. Get real. You should have asked the dealer (nicely) if they have seen this before, and if BMW would be predisposed to assist with a good-will repair. They probably would have responded positively.
