Hi. Had a similar issue with my 04 2.5 x3. The sunroof was replaced incorrectly by the dealer right before the warranty ran out. To make a long story short the car has been to the dealer with this problem numerous times and I have not had to pay anything including the CPO charge. I would check with the dealer again and if that does not work contact bmwusa. They might be able to get you a discount.
