This is a classic sign of the filter's O-ring had failed. Have you replaced the transmission filter at all?
Word of advice, which will save you lots of headaches - use only the BMW filter, which I believed is made by Filtran. It may cost a bit more, but you won't have to do it twice when an aftermarket filter will end up failing the same.

Had the same issue, did a trans service to help that out & it did.

I just bought the car a few weeks ago, so I haven't had the transmission serviced. Will definitely get that done soon. Appreciate it guys!

This kit uses an Elring filter, which I don't recommend. I would rather use this => https://www.ecstuning.com/BMW-E53-X5...ssion/ES44741/

Zero problems for me. ECS is a great company, they won't sell parts they wouldn't recommend.

I would also look at the underside of the X and see if you are leaking any ATF. ATF contracts when the temperature is low and if you are leaking ATF and with the cold weather the fluid level may be too low. Letting the engine run, allows the fluid to warm up and expand. If you are doing the work yourself, jack the X up and make sure it is level. Start the engine up and go underneath the X and open the fill plug. A slight dribble of ATF should come out of the fill hole. No dribble means the ATF level is low. Put the fill plug back in before shutting off the engine. Get some recommended ATF and start the engine back up and open the fill plug and start pumping ATF in until it starts to dribble out from the fill hole. Replace the fill plug and shut off the engine. Perhaps this is the reason why the previous owner decided to sell the X. They probably warm up the car before you came over so that the problem wouldn't crop up. I alway as a seller not to warm up the engine before I inspect the car.

I know you're new here, but be careful with ECS. They do sell good products but they also sell shitty ones. Don't shop blindly on there.

I think you should be careful with any vendors. I normally buy just BMW OE parts for the X5 so I order a wheel sensor from Turner Motor Sports. Gave them my model year along with my Vin number. They still sent me the wrong part. Informed them that they sent me the wrong part. They replied that according to the VIN number the parts was correct. Took a photo of the part they sent along with the old wheel sensor. They told me to send it back. So I sent it back at my cost and when I received my refund it didn't include any of the shipping cost but included a 15% restocking fee. WTF they made the mistake and I'm stuck with a 15% restocking fee along with two-way shipping cost. If they don't want to man up to their mistake than I don't want to do business with them.
