Angry P0193

I've seen a few other posts about this but thought I'd bring it up again in case anyone ha s recent,y seen this.

I have a low mileage 2006 X5, 3.0 with less than 75k. Very well cared for by previous one owner out of California. Yes, the car has California emissions.

The day after I purchased it, I filled the tank with premium as it had half a tank of who knows what. The car then threw a P0193 code and then today a P0189 code. Car appears to be running perfect. No hesitation, idles fine. Cleared codes and now they immediately come back after a few miles of driving.

The issue is, here in Ohio, to get an emissions check pass, there can be no codes and no pending codes plus the check to see if you have cleared the codes or disconnected battery. Going to bring back to my Indy who has the bmw diagnostic system but still was wondering if anyone has a clue.
