Help? Variable Intake System Codes 2820 in n62 x5

I have a 2004 x5 e53 4.4 n62.

I have an issue with two error codes 2820 and 2821. Can a nyone help with this before I buy a new intake manifold motor.

DME: Variable Intake System - Temperature Warning Threshold
DME: Variable Intake System - Plausibility

Maf sensor is new aftermarket (didn’t change codes).
Have taken off inlet manifold cleaned and checked.
All o2 sensors replaced also so can likely rule any interference there out.
Checked with battery well charged, no issues there.
Cleared many times, codes have lingered for 6 months +.
Have resolved all the other issues with car except these two codes, which linger.

Before I buy a new intake manifold motor (they aren’t cheap) I am wondering if anyone has had and fixed these codes.

I have swapped with an old used manifold motor, and inlet manifold as well, but didn’t change anything, codes keep coming.

Drives and generally runs fine otherwise.

This has got me really stumped and I am wondering if the other manifold motor I tried was also bad. But maybe someone else has some thoughts or has solved this?
