F'in BMW

So I bought what I thought was a CPO'd 2003 x5. It came with a everything i thought a CPO's vehicle would. Has CPO window sticker, bunch of brocures on CPO Vehicle Program, and a Statement of Certification stamped and signed with the proper VIN on it..

So for some reason it was not showing up on the national database as being CPO'd.. After quite a few phone calls to the dealer that issued the certification they are saying that it was never "fully" CPO'd as it went to auction. I said I did not get it at auction and I have a statement of certification. They come back and say that it does not matter it is not certified.

So the question is.. Is the Statement of Certification not a legal binding contract. It kind of reads as if it is. Any suggestions on what to do.. Am I screwed??

"By the dealer's signature and stamp on this statement, the dealer certifies: (1) this vehicle has been properly enrolled in the Certified Pre-Owned BMW Vehicle Program, etc....."

what the hell does being in an auction have to do with it?

most bmw certified cars were bought from auctions and then "certified".

Carfax most used BMWs and it will say "bought at auction".

Raise hell.

42K it is at 49K and still under factory warrenty now.. Until the 26th.. 8 more days.

Did you buy it from a dealer or a private seller?

The Certified Pre-Owned BMW Protection Plan is fully transferable from the original Certified Pre-Owned BMW purchaser or lessee to subsequent owner(s) or lessee(s).

if it is not cpo'ed then you can buy one before the original warranty expires.
Why dont you call the dealer that stamped the paper you have that says its certified
