Diesel transmission help!

My Australian delivered 2005 X5 diesel transmission gets confused between 1st and 2nd gear when accelerating from a standing start when cold (worse if on an incline). It will quickly change from 1st to 2nd and back to 1st again shunting the car about until the tranny is warm and it finds it's manners. This is the second transmission in my X to do this enoying gear change. BMW Australia have drawn a blank.

Thanks Zulu95 but it has the latest upgrade software as did my other transmission and it did the same bloody thing. It must be a solenoid that plays-up when the fluid is cold.

I have notice that the X5 start on 2nd gear most of the time when I start accelerating from standstill. I think it starts on 2nd because it is much more smoother ride but it is irritating especially at busy roundabouts. So what i do is put in on sports mode so that it is always on 1st gear and will not jump from 2nd to 1st when you pedal to metal at standstill.

Thanks vsx05. This problem could be very simple of very complicated. It drops to 1st when I come to a complete stop then jumps between 1st and 2nd causing power loss. Not much fun with traffic coming at you. Going sports mode is a way around it yes, but doesn't fix the problem.
