Convinced My Brother in Law to get an X5

So I've convinced my brother in law to trade in his 2005 Nissan Maxima for an X5 and we are going to go test drive two X5's one is a 3.0 and the other is a 4.4. His main concern is the gas consumption issue 3.0 vs 4.4, he wants to spend approx $30K-$35K. here is the search criteria:

Year: 2002 and up
Price: $30K-$35K
Milage: Under 50K
Comments: Must Have Navigation
Price: $35K

I have found two and would appreciate all your feedback, below please see pics of one of the two

Year: 2002
Miles: 25,600
Vin #:5UXFB33522LH34204

What do you think about the price?

by scanning the vin # can someone help me in finding the options that originally came with the car?

Thanks

On the pics this one looks indeed in great condition. What is the price for it? Is this $35k? Does it come with any warranty for that price? may be an extended warranty still remaining on it?

I assume it has the remainder of the factory warranty, the asking price at the dealer is $35.9K

Green?

Does he really like the green?

The nav is what is popping up the price...if you compared the est milage....I would give up the 60 miles per tank to have the ponies under the hood....he should feel a noticeable difference in the way the two different SAVs drive.

being a 4.4 owner myself I agree with the ponies comment, as far as the green I don't think he minds, the other car we are going to test drive is a silver 3.0 from Difeo BMW, I guess we should stick with a 4.4 but he has preasure from the boss (My Sister ) to not buy the V8 due to her being the main driver of the car, Perhaps I should convince her to trade in her Lexus RX for a 3.0

Is the green X5 from GreenwichBMW? The gold emblem next to license plate is used by them. What other options does it have?

I just checked the vin# for you on carfax, the car is ok. The car have had 2 owners. However it doesn't tell me the options it came with.

just judging by the pictures, I'm going to ASSume the green one had: cold weather package, heated steering wheel, NAV, rear climate package, premium package, PDC. Xenons would be nice, no? unfortunately the green one doesn't have it.... can it be CPO-ed? 35,900 seems on the high end for asking price, especially if it's not CPO....
