Experience with factory buy back?

Hello,

my 04' X5 4.4 has adjustable ride height suspension that cannot be repaired by the dealer (still under warranty).
In the fall of 2007 the car was in the dealer for 4 weeks, and in the fall of 2008 the dealer had the car for the better part of 6 weeks. Now the saga is starting again and the service manager has sent a puma file on my car to BMW headquarters. The manager anticipates that BMW will by my X back.
I bought the X in May of 06' with 16k miles CPO from a dealer, it had been a BMW executive driven car, so I am the first registered owner. I have 49k miles on it currently.
I am wondering if BMW is going to treat me right or attempt to put the screws to me.
Has anyone had experience dealing with BMW in this type of situation?
