You are right on. Technically the center rear is THE safest place for a child seat. It does have 3 disadvantages though.

1. It's physically harder (and harder on your back in particular) to load a small kid into the center when standing outside the car versus loading a kid into a side seat position.

2. If you have 2 kids then it's not ideal with the two car seats crammed next to each other.

3. No rear seat entertainment options!

We had Twins 6 months ago and have been using the rear facing seats all this time with no problems.
But the best part is just about to go to forward facing and install dvd into the headrest

Terribly disappointing, though not surprising at all, response from BMW NA. I too have received worthless answers/advice from them in the past.

Sheesh, my 19 month old son went from Rear facing to forward in our X5 since he was 6 months. All the clips latched fine both forward and reverse. He went from an Eddie Bauer rear to a Evenflow Triumph forward. They work fine.

Bringing this thread back from the dead as my wife and I are expecting real soon. Was this issue ever resolved? I am really surprised that BMW would put that disclaimer in the manual. I called BMW NA and they told me to ask my local dealership. Both dealer and BMW NA do not seem to know the answer as to why the disclaimer is there. Part department said they do not sell BMW infant seats specific for an 04 X5 and he hasn't sold a BMW infant seat the whole time he has been there.

I double checked with my local fire dept and my baby seat is set right using the latch system. He had no idea what the disclaimer was referring to and has not seen anything like that.

It is open to interpretation, but here is mine.

I saw nothing in the first post requiring a BMW carseat. It said not to use a universal carseat, which i interpret as one without the Latch system. It says you can get a BMW carseat with or without the Latch system, which is true. It doesn't say you must get one. You can also get one with the Latch system from many other manufacturers. I think it was a whole lot of noise over nothing, and soon after, BMW improved the wording in the owner's manual.

Scumbag Corporate Lawyers wrote that up (need to do something to justify their salaries) and convince BMW to add it to the owners manual as a CTA (Cover Thy Ass) move.

Perhaps they should add this warning in the next owner manual:

Driving or riding in a motor vehicle in which speed are inherently dangerous, and participation in these kinds of activities carry with it the risk of serious injury. People, and parents/guardians of children, must recognize and accept these risks, and take responsibility for avoiding them. BMW NA in no way accepts responsibility for the misuse of any of its products. It is highly recommended that drivers of all ages, and especially children, wear securely fastened, approved helmets. While many BMW products are intended for kids ages 1 and above, BMW, nor any of its principals, officers, employees or associates, does not recommend an age that parents can or should start their children participating in any activities why using the product. That is a decision that parents must make, with the possible help of their physician, and they must take sole responsibility for that decision.

Waiver that you must sign when you enroll your kids in skiing or snowboarding class, I just made some SMALL revisions.

We have this one in my '01. It is a recaro and matches the interior splendidly. Never had any problems. Wife's old man is a firefighter. He approves. Good enough for me.

JCL and upallnight - I agree with your interpretations. It's a vague statement for BMW to cover their ass from lawsuits. ISOFIX or LATCH were in most cars 03+. It's possible that BMW placed that disclaimer because it's an unfamiliar territory until they figured it all out in 2005. It just irks me they will not take responsibility nor do they want to give me a straight answer as to why it is there.
