Experience with factory buy back?

Hello,

my 04' X5 4.4 has adjustable ride height suspension that cannot be repaired by the dealer (still under warranty).
In the fall of 2007 the car was in the dealer for 4 weeks, and in the fall of 2008 the dealer had the car for the better part of 6 weeks. Now the saga is starting again and the service manager has sent a puma file on my car to BMW headquarters. The manager anticipates that BMW will by my X back.
I bought the X in May of 06' with 16k miles CPO from a dealer, it had been a BMW executive driven car, so I am the first registered owner. I have 49k miles on it currently.
I am wondering if BMW is going to treat me right or attempt to put the screws to me.
Has anyone had experience dealing with BMW in this type of situation?

My cousin had 2 M3's bought back by BMW. His 03' Imola Red coupe and 04' Titanium Silver due to engine issues. He was treated pretty well but they were both bought new so I'm not sure if that matters or not. He was actually given a swap from the 03' to the 04' and just had to pay for the additional options he chose on the 04' that the 03' did not have. He moved into an M5 though after the 04' so I'm not sure how well he was treated on that one. Between him, my other cousin and my uncle however, they've easily purchased at least a dozen cars from this dealership so I'd assume they'd bend over backwards a little bit for them as well.

In 96 my E34 had the "sulphur content eating cylinder problem".
Was offered a buy back but dealer was offering a ridiculous figure for trade in on an E39 at dealer cost.
BMWNA said they couldn't dictate the trade in value to dealer otherwise it would be price fixing.
I took the $10k and ran.

I almost had my car bought back by BMW. To prevent it, they actually sent a Spartanburg UberTech up to my dealer to look at the problem. Turns out my car had a faulty assembly straight out of the factory. They ended up not buying it back(much to my chagrin after finding out it's been f-ed up since Day 1) and fixing the problem.

My brother had the first model year of the 745i when it came out (2002?). BMW bought it back (along with MANY other 7s). He got a 745li of the next model year with some additional options for the same price as 745i they took back. It was less than a year old and probably had less than 15K on the odometer. I'm not sure what they would do for a 5 year old car with 49K miles on it. Good luck.

Thanks for all the input everyone. I got approval yesterday that BMW is buying my car back, I'm so relieved. Since I plan on getting another X5 (w/o adjustable ride height), I asked BMW to see if there is an executive demo in the fleet that I could obtain. That may be the best solution, since sales tax just increased here April 1st.
My ideal replacement would be a 2006 4.4 or 4.8 w/sport pkg, premium pkg, cold weather and remianing BMW maintenance warranty.
The 4.8i seems to be a long shot for me, since every example I've seen has adjustable ride height, but you never know, I recently saw an X5 here with no sunroof.
