tailgate manual latch

2001 X5 3.0 sport...So I might be blind, but I cannot for the life of me find the latch mentioned in step 2 of the manual tailgate release section on p.188 in the manual!

I can unfasten the trim panel clip and take it out so only the lower piece remains. But in the manual it looks like the latch is just sitting htere...on my car there is a bunch of foam. Even when I look behind the foam I don't see it!

Grrrrrrr...can anyone clue me in?!

Are you sure you removed the right trim panel?

I believe so...In any case, I just applied a little downward pressure on the tailgate and it came unstuck.
