Going with the buy-back on my 4.8is

So after the last 8 months of hassle with the car, BMW NA asked to complete the buy back. They are willing to refund all the payments on the car, but not what I spent out of pocket. The dealer asked me to bou new tires, new wheels and several suspension parts and they said that would fix the problem. It didnt, but since I went and bought those items outside of the dealer, they dont want to refund. It's about $10k worth of receipts. What are your opinions on this? Has anyone gone through this process? Should I involve a lemon law lawyer? Thanks

why did you buy the parts yourself? wasn't the car under warranty? do you have a link to a thread that describes your problems?

Actually I am surprised that BMW is buying back a 5 year old vehicle. Did you buy it new, or was is a CP0?

For the most part, I believe the lemon law doesn't apply to used vehicles. State laws will vary though. You'll be able to sell the wheels and rubber pretty easy. How much of the 10K were wheels and tires? Are they OEM?

I think we're all saying we need more information.

Haha, sorry, i actually posted this last night. I bought the car used with 30k miles and still under manufacturer's warranty (when the problem occured). Right front rotor kept on getting warped when new and the car would pull the to the right. I have gone back to the dealer more than 13 times with the same problem and they replaced calipers, rotors, wheel hubs, bearings, brake lines and numerous suspension parts. Still no difference. I got BMW NA involved and they made an offer to do a full buy back on the car + the payments I made so far. I was told by the dealer I had an option to go out and buy new tires, wheels and misc items that they said would fix the problem and not covered under warranty. I went outside of the dealer because it was 50% cheaper.

They will be taking the car so i cannot sell any parts from it. Everything is OEM.

that last little bit there sucks... they should be responsible for everything. i dont think that you will get any of the money you spent outside from the dealership back.

edit: meaning that they should have been buying the parts not even mentioning to you to go buy parts.

I think it is a numbers' game. Yeah, in the spirit of fairness, I think you're entitled to everything but I would probably take a haircut on the tires / outside work especially if you don't have written proof of the dealer 'advice'
