Going by your location, the "Max" button will only work with the ignition in the off position. Are you saying that it still doesnt work?

So its temp related? If it only works with the ignition in the off position, what is the diff between that and aux ventilation?

It works in the off position with the engine at operating temp not at first start up.

Vitriol is on a distinguished road
i have this same issue, its when it gets too cold outside, when you turn on your car, it will chime and tell you the external temp, i think it does this below 37F
when it does this, it wont let you hit the max button on the heater/ac, probably an intelligent system that waits for the engine to heat up instead of putting a ton of strain

No, the issue with that is that it'd blow cold air at you. Even if you put it in auto mode, it blows air only after the engine is partially warmed up. After all, you get hot air from the heater core/exchanger, ie. hot coolant .

Mine works in the summer..if I hit the max button it blows full speed ahead...

That is how it should work. It overrides what BMW calls the "Y factor".

alright, but end result

too cold outside = disabled max blower button

and this is normal
