So it seems he has a dealer's license and buys cars off auctions and then sells them on the street or craigslist. He was cool about the whole thing so I just went, dropped it off, and got my money back.
All done, t'was nice having an X5 for 2 days.

Glad it all worked out!
Here's how I buy, for what it's worth.--find a vehicle that has the history of repairs or in some manner or fashion get the history. If that is not possible I almost always move on to the next one. When I find one with the lion's share of the history I do a pre purchase inspection from a dealer or highly recommended BMW independent shop. In the case of used X. First goal would be one with a year's worth of factory warranty left, is certified or I can buy a good extended warranty. If I can't do that it would be one that is 75,000 miles or less. If it has been cared for, the more costly wear items should be 25,000 miles away. If it is over 100,000 miles and wear items like moving parts of the suspension have not been addressed, I would walk or be sure that it is priced accordingly. I feel much better buying from a private owner that is an enthusiast or the BMW dealer where full exclosure should be more important. Takes longer to find something and tries my patience but if I don't I can't relax and enjoy the ride.

Glad you got your money back... it's likely the Seller knew there was shady crap going on and would rather not get into a war with you.
If you wanna travel, got a 2003 4.4L Blk/Blk in great nick with 125K miles on it. Runs and looks great - $10K+
