of course you are at fault: if you were not there in the first place, they would not have damaged your vehicle... which, makes me think, if the BMW did not produce that vehicle, there would be no vehicle to damage... i guess, it is not your fault, it is the BMW's fault... but, come to think about it - if there were no cement wall, there would be nothing to damage the car against... so, maybe it is the city's fault...

dude, if you let them play this game, they will blame the mother nature for having mankind on earth!!! what does your insurance say? are they going after the wrecker??

Show the tow company the officers notes that states THEY damaged the vehicle, send them a certified letter with the police notes, estimate for repair and a letter stating you are giving them 30 days to get a check for TOTAL repair $s in your hand PLUS rental car $s for the estimated repair time. Make clear you will proceed with legal action (including all court costs and lost time from work), if the 30 days passes without payment IN FULL.

Get your insurance co involved and you may see higher rates due to a claim.

just got off the phone with the insurance company.
Armada Towing is admitting they damaged my vehicle but they refuse to pay any damages.
They admitted it to my insurance company but I still have to pay to repair the car

I refuse to talk to anyone at Armada and I'm currently seeking a lawyer. it's to late I'm pissed I'm going after them for everything I can.

OK, reality check here! You MUST inform the tow company IN WRITING (retain a copy of all docs I noted above), of their liability in the damage to your vehicle and your intention of going after them for ALL costs incurred in the damages to your vehicle that they caused.

These docs will help if you have to go before a judge to recover costs.

Going before a judge stating "Armada responded to my insurance company -insert ANYTHING here-" is heresay! You can't repeat anything passed to you from your ins co, it was not stated to you and therefore it holds no water B4 a judge.

Send the certified letter (Armada is hoping you don't, it weakens there position should it go to court and I will bet it will get you paid because they KNOW you are not playing and do not intend to drive a damaged car around).

If you file in small claims court, you will need to subpoena the officer who wrote the note that implicates Armada, the judge will want to hear what he witnessed.

Do this and you will slam dunk the a**wads at Armada.

If you let a lawyer do this on your behalf he will pocket at least a grand for a couple hrs work.

Keep cost notes (certified mail, copies, travel time/miles if you do a parts run, any cost incurred), provide a copy to the judge and the Armada rep in court, tell the judge you want reinbursment for everything.

Sounds good. Respectfully, once it goes to attorneys the fees will exceed the damage in a few billable hours.
