2013 X5 fob/entry issues

Ok…. The battery was good, swapped for new, it’s good. Voltage:3.3.
Can walk out and it’s work normal. An he later walk out and it doesn’t work at all. Will have to open door with key. Can then sit in car and it work normal; doors lock/unlock, hatch opens, etc. walk outside and the same, all works.
Walk inside for half an hr, come back out and nothing! Same as above.
On the other hand, can wait till morning and half the time it will work as normal.
Has new battery, Batt has been renewed. No codes. Have BimmerLink and bimmercode, if anyone knows something.
