When I had my problem with Xena, I wrote to the customer relations e-mail address on BMW UK website, and got a very apologetic reply, and some money back as a one-off gesture. That was enough to cover off the inconvenience. Since then my car hasn't skipped a beat.

Another update.

Overall I'm pretty patient and give people the benefit of the doubt.

[atl_lex77] I believe the entire sway bar was swapped out but I can't track down the part number in any database.

[vinuneuro] The seats will be considered the third strike. I did not report the tranny because I was told the behavior is "normal" or dynamic drive because it could not be duplicated on the last visit so I guess that is considered "strike 2." The noise in the back will be considered a 2nd incident since it was agreed the 2nd visit was a continuation of the first. One thing I did read is that Massachusetts can define a "lemon" as either 3 strikes for an incident or a vehicles is out of service for 15 or more non-consecutive business days. Right now that number stands at 23. The phone call today can be considered "notice to manufactured" according to the law. Guess I set things in motion without even knowing it.

X5 911 is on a distinguished road
The squeeking from the back is probably caused from the panels that are between the seats and the rear compartment not being glued properly. This happened with ours and after 13 trips it was finally diagnosed properly and remedied. They laid the rear seats down and glued them and then sat sandbags on top of it and let it sit for several days. No more rattles/squeeks.

I have a squeak, but I don't have 3rd row seats. I have not been able to find where the noise is coming from. Rear somewhere.

Ours was in the 2nd row of seats not the 3rd row.

Well I think I would fault the dealer at this point, while my situation was very different, I got my 07 swaped out for an new 08. it was not lemoned but my Dealer worked with BMWNA to get it done.
The X just came in too.
