I lived in Boston for 13 years. In 2000, I got a cracked rim driving over an unavoidable pot-hole in a major street in downtown Boston in my M3. I submitted a letter with a picture of the pot hole showing the lack of visual aids to warn drivers, and the city sent me a refund check (it took 3 months) So try it! make sure you have ample documentation, i.e. location of the pot hole, and invoice from BMW for rim replacement, etc.
