As you should know, getting a production number and seeing it on the BMW USA website (which is far from accurate), doesn't necessarily mean that your car was being built during that allocation cycle. Did you get a production week confirmation (back in December) by the dealer or a BMWNA rep that coincides with that month or at least a relatively short time after?
Having a production number just means that your car was put into queue in the factory system (status 112). There are numerous examples of this on the bimmerfest forums. People with legitimate production numbers, appearing on the website and able to be tracked, but cars slated to be built 6-8 weeks out. Dealers can tell through the dealerspeed.net when SOP is about to happen for current allocations (builds that are anywhere from 1 day to 2-4 weeks out before status 150). And often when they've used them up, they get their next batch and queue them into the factory system, giving some slots to custom orders and some slated for dealer lot. These are ones that are slated to be built 6-8 weeks out. I would place my bets that this is what happened with you.
How can he promise you a first run of a new MY2011 to be delivered to you 3-4 weeks out after a 2010 is being discontinued. He has no control over EPA/CARB, no control over environmental factors (ie: volcano), or the whole gamut of -possible- delays with the new car. Your car was built in week 15, thats not even the first set of X5s out. They never stopped production for the MY2011s, even with the supply issues of the seat modules. You unfortunately were the unlucky one, among the batch of cars sitting at the VPC. You even stated that you tried negotiating a deal for a loaner if problems arise, and knowing the owner, this kind of courtesy should've been extended. It hasn't happened, so what does that say about the dealership and the treatment you've gotten? Yet, you still continue to defend them.
There are just too many unfortunate coincidences when it comes to your dealer and the stories he's given you. Back in December, he could've given you a production slated to be built that month, if he had any in the system. It's obvious he didn't, instead you get a car slated to be built and delivered in March because of some Nav delay 10 weeks out? Sorry but I refuse to believe that.
There are some holes in the dealer's story, because I actually started to think about getting my 4th X5 (a 48i) back in late January, and had an order placed and ready for SOP week 7, with delivery in early March. The car came in and I walked away from the deal because the dealer's F&I started playing games after I drove 280 miles in to take delivery. Since I couldn't order another so close to the MY switch, I signed a deal for a MY2011 50i SOP week 14 with a different dealer 1200 miles away and I'm glad I did. My car was delivered to my dealer over a week ago on May 1st.
