2010 35d Service Nightmare and Question

So I took my 2010 x5 35d into the dealer for my first service at around 10600 miles. I thought all would go smoothly. Wrong. The normal service went fine - oil change and DEF change. However, there were a couple of service campaign items that were due on the vehicle according to BMW. One was for a software update (reprogram DDE Data status). Well the software update failed and something called a CIC module failed. Apparently the work order shows that they tried various things but apparently they replaced the CIC module and they had to reload the navigation system.

In layman terms, the situation they said caused them to replace the audio system. My first thought was about my Sirius subscription and they assured me that would be ok. Wrong.

In the end, when I go into my car I noted that the Sirius radio would not work. I called Sirius and they told my the radio had never been registered and that I had to pay a fee for a new subscription and that the rate per month has changed also to more than I was paying.

So a couple of questions:

1. Has anyone else had this problem with the reprogramming of the software on the 2010 x5 diesel?

2. Do you think the dealer or BMW will reimburse me for the Sirius fee for the new radio and the cost that each month will be more than I was paying under my current contract?

3. The navigation system was reloaded with Premium 2009-2 Discs 1 thru 3 - is that the version I had before or is there a newer version they should have loaded?

All this is related to a 2010 x5 diesel that I bought in November 2009 that was built in October 20009. It had the premium sound system option.

1. No, you should not have to pay a dime more for sirius- they should absorb 100% of the cost.

YOU did not have a failure of the sirius radio, THEY did. Everything that they need to do to give the car back as it was when you brought it in for service is 100% theirs. They may try to argue 'the warrranty doesnt cover subscriptions'...say "I am not using the warranty to fix the radio, I am claiming it was gross negligence and incompetence on your part to break it while performing a BMW recall". Should bring them up short.

2. They only 'owe' you the maps you drove in with. I'd say you could negotiate an upgrade as good will.

3. Bring it in and have a typed out piece if paper with your complaint. Say "I want this text typed into the work order, nothing short is acceptable".... you see, they will type in something like "C/S sirius not working, check and advise" (C/S= is customer states...which allow them to say "we never said it, customer did"..hard to avoid, but at least get it factual..... you want it to say "Sirius module replaced at last service (SO xxxxxx) due to error during recall was not activated by dealership. Module to be reactivated and subscription resumed"

BIG difference.

For the Sirius part, it makes no sense to me. I would expect the Sirius ESID to be the same since it is normally an external tuner.

You get a free year to Sirius with a new BMW. It does have to be activated and Sirius sends you a welcome packet on activation. So -- the first step it to see if the ESID changed.

If it did change, Sirius should be willing to roll over the remaining time on your original free subscription to the new radio.

Note that I use the Sirius website to do most stuff, it will show the ESID and subscriptions you have.

You may want to scan and post your receipt from the service. That will help folks to understand what they did.

The CIC is the "car information computer" and is the main module in control of all radio/entertainment/nav systems/i-drive etc. For some reason about a third of them fail programming recently and need replacement (common on a few different models). The dealer is the one who needs to take the measures to get the Sirius back up and running, on BMWNA's dollar as it is their program that killed it.

I'd make the appointment to bring it back in and have them take care of that for you.

That explains alot.
I will hold firm on the Sirius.
Is everyone sure they loaded the Nav system that I had before - in other words, they did not take me backwards?
If there is a new Nav system update then perhaps I will use as a bargaining chip on their nickel - is there a new version for my 2010 x5 diesel?

On 2010 my cic, the Sirius receiver is now part of the cic itself, along with the hd radio for that matter

The fact they changed the cic will mean your sirius receiver will have a new ID code.

Also BMW will have needed to order the Sirius activation code to ensure Sirius is even available on your cic.
