i guess op is a perfectionist. but for a perfect car, 70k can't do it. to get a perfect car op should consider a ferrari or lambo, but it might catch on fire. so maybe a AM or bentley should do it.

It's just that I bought (previously) also a brand new 2009 xdrive48i, every other week it was giving problems (I have posts on this website about the details). I lemoned that and I was happy because they gave me my money back. I gave BMW another chance by purchasing a sport pack xdrive35i, 200 miles in and now this. I will inform their HQ, and see what happens.

I there are many service bulletins on the seat creak now, pretty much a fix for any creak possible on the seat. I'd let the dealer try fixing the seat then see if anything else goes wrong before pursuing the lemon route again. But as far as I know the perfect/infallible vehicle doesn't exist... so I wouldn't let a minor issue of a seat creak upset me that much before you even let them try to fix it.

I suggested the black plastic trim adjustment under the seat... I did this over 2 years ago and the creak has never come back. Lucky me i guess.

Sorry rh71!! I thought it was ard. I did this black trim adjustment...and the creak went away for about a day (maybe 1/2 a day), and then it came back!

I have had a "seat noise" problem. This may be different than yours but I will outline mine, as reference. First time I noticed it, I brought it to the dealer. They said there was friction between the seat belt and the leather seat, close to the center console side area. They put some cream onto that area. The noise disappeared for a day, then came back. I went back the second time. They did the same thing and the same problem returned. I went back the 3rd time. They sent out their "master mechanic", a gray haired, very experienced looking guy. He said the same thing and did the same thing to fix. Guess what, the same problem returned. The 4th time, I did not return to the dealer. I do not run 5 businesses but I have better things to do. I simply put a "sticker" between the seat belt and the leather seat where friction was observed. The problem disappeared immediately.

I paid $66K for the vehicle, which includes certain BMW expectations to come with it. I have to agree with the OP, for that kind of money, BMW's performance is sub par.

$66K does not buy a perfect car, of course. But, I have driven numerous less expensive cars in my life. I have never had this problem (when the vehicle is new).

My two cents.
