We ended up buying an 09 X5 35d with the third row and there are hard plastic bits on the bottom of the seat-back for sure. I will post some pictures of exactly what I am talking about when I have a moment. Still not positive about the metal gate either as there are no anchor locations on the ceiling like there were in my e53 and I don't see where it would attach to the back of the second row seats or the cargo floor.
