I would say that if you're buying a new car, your stealer should give you the current version. The current version is 2009.1

I have a 2005 X5 and live in the North East USA. So when Navteq says the 2009 maps have been updated from 1.7 M POI to 7.3 M Points of Interest does this mean the updated POI's are ONLY for those cities that were updated? Or does that mean the 7.3M POIs across all USA cities have been updated along with adding coverage for those other cities? None of those cities are in the North East so any reason why I should get the 2009?

The 7.3 M POI refers to the entire country, not just those new cities.

I'm also in the Northeast (NYC area) and there are a number of corrections on the new disc. The updated cities they list are when they go out and survey every street. That's areas where the "Correct destination guidance not possible" message overlay shows up on all but major roads (the rest appear in thin gray).

NAVTEQ also gets feedback from customers (there's a web form, but if you call they can pull up the location of the error and let you know if it has been corrected yet, and if so, in what release).

You just have to careful in what you ask for - I asked for Champaign, IL to be added and when I got the next map update, sure enough it was there - but they left out Urbana, IL. Odd since UIUC stands for University of Illinois at Urbana-Champaign. One more call and I got Urbana and the nearby unincorporated parts of Champaign County added to the next map update.

I'm having problems with the 2009.1 release in my '04 X5. Searching for POI's causes the system to crash and reboot. Will be taking back to dealer to see what's up. I've read reports of unreliable behavior on other forums, too.

Wow! I guess I'd better step up and get with the times. My only thought would be to take it back to the dealer and get it updated. Are there other ways?
