Thats my point. This officer said you were following too close so you won't be able to disprove it. I believe you said that when he was done you only got a ticket for - an infraction for following too closely - and a warning for speeding and unsafe lane changes. So you got off for the more serious offenses which leaves you with an infraction of following too closely. An infraction you admit is subjective since this officers own interpretation/observation comes into play. I believe you will have a tough time pleading your case with the judge. I mean what are you gonna say?

If this would not hurt my record or add any points or effect my insurance I would give serious consideration weather it would be worth my expenses to fight a losing case. Honestly: I know how you feel. I just went to court regarding parking in a yellow zone. Yes I was right, Yes I had the evidence, and yes I won the case, but it took time and my financial resources to get thru it all. Your outcome from my perspective may not come out the same and where's the satisfaction in that. At any rate I wish you the best. Quote:

You should hope that the cop won't appear at the tial. In my case, local Sheriff's dep. shares walls with the court house. CHP is only 10 miles away. So it didn't stand a chance for me. It is very likely that judge won't take your word for it. Good luck to you. |
Thanks, I appreciate it.:thumbup: I'll see what ticket assassin has to offer and use the delay tactic as long as possible if things don't turn out in my favor. I don't plan to use those other possible reasons as part of my arguments at all. I'll just stick to the facts and hopefully I can come up with a well written declaration as i do not want to appear in court.
My last recourse is to pay the fine, and take traffic school online if that's what it takes to get the points off my record. BTW is an infraction a point on your driving record? Because it is not marked as a correctable violation in the ticket. |
Type the infraction in google ( It's on your ticket) It may come up in the California Vehicle code. Then cross check it with a friends indepandant insurance agent.
