Sump Failed: Basement Flooded

We got a lot of rain last night. When my dad went down to the basement this morning, he found about 1-2" of water accumlated through all of it because the sump stopped working (pump switch works only if you giggle it a little). A plumber came today and said that the sump pump/ float clearly failed. The thing is, 2 months back the old pump got stuck in the on position, so we replaced it with this one. The warranty on this one is for 1yr. Manufacturer says to send the pump in and they will assess whether it was a pump failure and reimburse for damages accordingly. I think that's bullsh*t because I already foresee them giving some excuse. What to do?
