Cut & Shut an X5?

What they are proposing in this Ebay auction can't be legal can it?

To get the best out of a very sad situation I'd be more inclined to remove the near new engine, transmission and electrics and use them to replace those in a flood damaged X5! No cutting and welding required, no messed up driving characteristics.

If you ever see an X5 driving down the street sideways, it will probably be this X5. I doubt that it nor its occupants will survive a next major crash. It's stupid that two vehicles welded together as one can pass certification, but it's happening everywhere.
