I can't imagine any insurance company would pay when their client is convicted of DUI. Why don't you simply call them and ask?

I am thinking the opposite.
I am guessing the insurance company has a legal responsibility to cover the damage in the same way if someone did something else illegal, say for example, speeding, running a red light, etc. Now, I am guessing the insurance company will probably drop the DUI person from the policy, but maybe not... They make so much money (the insurance companies) that they often make more from people with bad records. So it's in their financial interest to jack up the rates. Again..I am just guessing though. Never been convicted of a DUI. B

I agree with B-line. I believe the insurance company is responsible for covering the insured even in the case of a DUI. However, whether or not the insurance company continues to cover the client is another question

Insurance coverage is NOT voided by DUI. Although we all might want to say it should be, just think about the others who would be left unpaid if the insurance didn't pay up --other drivers, hospital, doctors, ambulance services, property owners, and then taxpayers if the person ended up on welfare because he didn't get treatment for injuries.

Agree with StatDoc and B-Line: ins. should cover what
they would cover under "regular" circumstances. No idea of Cali law/impact, but in NJ/NY, a DUI is a very expensive process: lawyer, court, fines, loss of license for 6 months, points on record and then...the search for car insurance which will be really expensive. NJ had a surcharge on top of whatever one had to pay after finding an ins. co. that bent you over. I had 2 guys that worked for me, that went through this: a tough and expensive lesson, but there is absolfookinlutely zero reason or excuse to drive past .06 or .08 alcohol, imo. Cabs, buses, car service, friends, walking...etc. GL, mD |
