Atty Question: Topic: Chapter 7 Bankruptcy

For any bankruptcy attorneys out there....

A good friend of mine had to file chapter 7. The only contesting "creditor" is a private school which his kids attended. He had not been paying for several months and the current amount in arrears is about 14K.

The school says this money was a "student loan" and those debts cannot be disolved. My friend says he signed an enrollment agreement, not loan paperwork.

Can this debt be excluded from a Chapter 7 and be classified as a student loan?

Thanks for your thoughts...
